Here are the full terms and conditions for PostArt competitions. Please read these carefully before entering one of our competitions. By entering a competition published in any newspaper/publication and/or online for PostArt, the participant in the competition agrees to the terms and conditions set out here.
These terms and conditions and any terms and conditions set out in the competition advertisement or promotional material are referred to as the “rules”. In these rules, the term "competition(s)" includes games, promotions and the like, "PostArt" or "We" means PostArt Ltd, and “participant(s)” means any person(s) taking part in a competition. The individual competition requirements must also be met.
1 Unless otherwise stated in a competition advertisement the promoter of all competitions contained within the publications is PostArt Ltd whose principal place of business in the United Kingdom is [44 The Thicket, Fareham, Hants PO16 8PZ (the “promoter”).
Eligibility of participants
2 To enter a competition all participants must comply with the entry requirements stated in that competition advertisement and/or promotional material. The participant acknowledges that failure to comply with the rules may result in his or her disqualification from the competition.
3 Unless otherwise stated, entry to all competitions is restricted to participants who are residents of the United Kingdom and 18 years of age or over.
4 Where participants are required to enter in one of several age categories, the relevant category for each participant shall be that category appropriate to the participant’s age on the closing date of the competition. A participant is assumed to be of a certain age up to and including the day prior to his or her next birthday.
5 Employees of PostArt or its associated companies or their agents or members of their families are not eligible to enter any competition in a publication.
6 If a promoter other than PostArt or its associated companies is named in a competition advertisement as the promoter of the competition, employees of that specified promoter or its associated companies or their agents or members of their families are not eligible to enter that competition.
7 The promoter has the right at any time to require participants to provide proof of identity and/or eligibility to enter the competition. If a participant is required to provide such evidence and fails to do so, then PostArt may, at its discretion, decide to disqualify a participant from the competition or withdraw a prize.
8 When requested, the participant must provide full, truthful and accurate information to requests for evidence of eligibility to participate and must not mislead the promoter. If PostArt believes that information being provided does not comply with this provision, then PostArt may, at its discretion, disqualify a participant from the competition or withdraw any prize.
9 Names of winners and results of competitions will be published on www.postart.co.uk or may be published in the relevant editions of the publications as circumstances permit.
10 The determination of the PostArt shall be final in relation to the eligibility of any participant. No correspondence will be entered into about a decision regarding eligibility.
11 Unless otherwise stated, entries must be received by the promoter no later than the published closing date for the competition.
12 Proof of posting, emailing, sent SMS (“short messaging service”)/text message, sent MMS (“multimedia messaging service”)/picture message/video message will not be accepted as proof of receipt of entry by the promoter and no responsibility is accepted by the promoter for entries lost, delayed, mislaid or for any technical failure or for any event which may cause entries to the competition to be delayed, deleted, misdirected, disrupted or corrupted.
13 The promoter is not responsible for incomplete, unclear, incomprehensible or distorted entries. Such entries will be void.
14 Internet
Where the selected method of entry is by e-mail or internet submission:
• The cost of such submission will be free subject to any arrangement between the participant and his or her internet service provider.
15 The promoter is not responsible if the e-mail or Internet entry made by the participant is disrupted, unclear, distorted, undelivered, delayed or affected in any way beyond the reasonable control of the promoter or any third party employed by the promoter to administer competition entries. The promoter is not liable for any charges incurred by the participant for any Internet connection or e-mail.
Change of Rules
16 PostArt reserve the right, acting reasonably, to change the rules applicable to any competition or to void any competition at any time and for any reason. In the unusual event that a competition is declared void for any reason, PostArt will use best endeavours to refund all participants. Subject to the participant providing proof of payment of the entry fee (e.g. itemised phonebill).
17 In the event of an error, howsoever caused, whether a printing, technical or other error and whether obvious or otherwise, which affects the competition in any way, the PostArt reserve the right to administer the competition in a fair and reasonable manner and may if appropriate, engage an independent third party to conduct a prize draw. Where PostArt deems it appropriate and/or feasible PostArt will notify participants of the error and correct it either through its website www.postart.co.uk or through any other suitable medium.
Tie-Breaker
18 Where necessary in order to determine an outright winner or winners to a competition, PostArt reserve the right to request participants to take part in an eliminating contest (or 'tie breaker'). Where for any reason there are more winners than prizes on offer the PostArt reserve the right to conduct an independent draw to determine the winner or winners of the prizes.
Prizes
19 There is no cash alternative to the prizes and prizes may not be substituted for other prizes, unless specifically stated in the competition advertisement or promotion. PostArt offers prizes subject to availability and reserves the right to substitute prizes for a similar item of equal or higher value if the stated prize is not available.
20 Unless otherwise specified, prizes may take up to 8 weeks to be delivered. Winners shall be notified by telephone or post unless otherwise stated.
21 If a cash prize is stated to be payable to a winner, the prize will be provided by way of a cheque made payable in the name of the winning participant. Cheques will not be issued to third parties.
22 Participants are responsible for paying all taxes, duties and any other levies on prize winnings.
23 If the winner of a competition informs the promoter that he or she is unable to take up a prize for any reason, the promoter reserves the right to award it to an alternative winner, in which case the first winner chosen will not be eligible for any share of the prize whatsoever.
Publicity of Winning Entries
24 The participant agrees to his or her name and county of residence being published in connection with a winning entry in the competition and agrees to the promoter disclosing his or her name and county of residence on the promoter’s website and to any individual requesting the name of the winning participant.
25 The participants agree not to enter into correspondence or give interviews with any person other than the promoter on any matters arising from any competition without the prior written permission of PostArt.
26 The participant agrees to co-operate with the promoter including its photographers or reporters to publicise their win as PostArt deems reasonably requires.
27 Neither the promoter nor PostArt (if the promoter is not PostArt) is under any obligation to publish any competition entries supplied.
Participants’ Obligations and rights of PostArt Directors
28 The participant confirms that:
• he or she has the right to submit the competition entry in accordance with the rules of entry;
• all entries submitted by the participant are legal, and truthful and comply with all applicable laws, regulations, standards or codes of practice;
• all entries submitted do not infringe copyright, design, privacy, publicity, data protection, trademark, or any other rights of any third party
• all entries do not contain any abusive, obscene, threatening, libellous or defamatory material.
29 The participant has sole responsibility for his or her entries and each participant agrees to indemnify the promoter and keep the promoter fully and effectively indemnified on demand from and against all actions, claims, losses, liability, proceedings, damages, costs, expenses, loss of business, loss of profits, business interruption and other pecuniary or consequential loss (including legal costs and expenses) suffered or incurred by the promoter and/or PostArt and arising directly or indirectly out of the publication of any competition entry submitted by the participant.
30 Failure to comply with any of these rules may result in the disqualification of the entry. PostArt reserve the right to disqualify any entry at their absolute discretion and may edit, reject or remove entries if the PostArt believe that the entries do not comply with the provisions of paragraph 37 above or are deemed by the PostArt to be inappropriate.
31 PostArt’s decision is final in all matters concerning a competition.
Data Protection
32 All personal data provided by a participant to the promoter in connection with a competition entry will be used by the promoter, its employees, suppliers, contractors and agents to process the competition, to inform winning participants of their winning entry and to distribute prizes.
33 All personal data provided by participants will be processed by PostArt in accordance with PostArt Privacy Policy set out on the PostArt website. PostArt reserves the right to use participants’ personal data to inform them of future promotions. If participants do not wish for their personal data to be used for this purpose then they must 'opt out’. Once you have entered a competition you may receive other related promotional offers / services via email or postal service. Limitation of Liability
34 To the fullest extent permitted by law, the promoter accepts no liability for any loss or damage of any nature whatsoever and howsoever arising out of or in connection with a participant’s entry into the competition (including the use of any prize) and the promoter’s use of the entry whether due to inaccuracy, error, omission or any other cause and whether on the part of the promoter (or its servants, agents or any other person or entity).
35 If the promoter is liable to a participant for any reason (other than death or personal injury arising from the promoter’s negligence), the promoter’s liability will be limited to £100. Notwithstanding any other provision of these rules, the promoter does not attempt to exclude or limit its liability for death or personal injury resulting from its negligence in any way.
36 To the fullest extent permissible by law, the promoter does not make any express or implied warranties, representations or endorsements whatsoever with regard to the competition prizes or any information, service or product provided in connection with a competition.
Participants from outside the United Kingdom
37 Open to UK residents only. Overseas players are not eligible.
General Provisions
38 If any provision or term of these rules shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from the rest of the rules and shall be deemed to be deleted from them.
39 Any failure or delay by the promoter in enforcing an obligation or exercising a right, under these rules, does not amount to a waiver of that obligation or right or any other obligation or right.
40 The participant acknowledges that he or she has not agreed to these rules in reliance on any statement or representation, except in so far as the representation has been incorporated into these rules. The participant irrevocably and unconditionally waives any right the participant may have to claim damages and/or to rescind these terms and conditions by reason of any misrepresentation (other than a fraudulent misrepresentation) not contained in these terms and conditions.
41 These rules and all competitions included in the publications are governed by and construed in accordance with the laws of England and Wales and the English Courts will have exclusive jurisdiction to determine any proceedings in connection with this competition
42 In the event that a promotion has generated insufficient correct entries, PostArt reserve the right to distribute the rest of the prizes to incorrect entries based on a draw.
